1. Agreement
These Terms of Service (“Terms”) govern your use of POV Living (the iOS app, related APIs, and optional Discord community). By creating an account or using POV Living, you agree to these Terms. If you do not agree, do not use the service.
2. The service
POV Living is an interactive storytelling product. You can browse and create story worlds, chat with AI-driven characters, socialize with other players, and optionally join our Discord community. Features may change as we improve the product.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country). Mature (18+) worlds and content are gated by age rating settings and your preferences. You are responsible for complying with local law.
4. Accounts
- Provide accurate registration information and keep credentials secure.
- You are responsible for activity under your account.
- Do not impersonate staff, brands, or other people.
- We may suspend or terminate accounts that violate these Terms or harm the community.
5. Your content
You retain rights to stories, characters, comments, messages, and other content you create (“User Content”). You grant POV Living a worldwide, non-exclusive license to host, store, reproduce, and display User Content as needed to operate and improve the service (including sync, moderation, and backups).
You represent that you have the rights to the content you post and that it does not infringe others’ rights or break the law.
6. Acceptable use
You agree not to:
- Harass, threaten, or target other users or creators.
- Post illegal content, including CSAM or sexual content involving minors.
- Spam, scam, or run unauthorized automation against the API or app.
- Attempt to breach security, scrape private data, or reverse-engineer beyond lawful rights.
- Share pirated builds, leaked TestFlight links, or circumvent subscriptions.
- Use the service to generate or distribute malware.
Report abuse in-app and/or in Discord #report-content. Staff may remove content and restrict accounts.
7. AI-generated content
Character replies and scene narration are generated with third-party AI (including Google Gemini). AI output can be unpredictable, incorrect, or unsuitable. Do not rely on AI for professional, medical, legal, or safety-critical advice. Do not put sensitive personal data into chats that you do not want processed by AI providers.
8. Subscriptions and purchases
Paid plans (including User and Creator) are processed by Apple via In-App Purchase / StoreKit. Billing, renewals, cancellations, and refunds are governed by Apple’s terms and your Apple ID settings. Plan benefits (such as deep immersion features or profile customization) may change; we will describe material changes in the app or Store when practical.
9. Discord community
Our Discord server is optional. Server rules and Discord’s Terms also apply. Linking your Discord account may sync plan badge roles. We may moderate, mute, or ban users who violate community standards.
10. Intellectual property
POV Living branding, software, and non-user materials are owned by us or our licensors. Except for your User Content and rights granted under these Terms, no license is granted by implication.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that AI scenes will meet your expectations.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POV LIVING AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
13. Termination
You may stop using the app and request account deletion where available (subject to legal retention needs). We may suspend or end access for violations, risk, or operational reasons. Provisions that should survive (licenses already granted for operation, disclaimers, liability limits) survive termination.
14. Changes
We may update these Terms. The “Last updated” date will change. Continued use after changes means you accept the updated Terms. If changes are material, we will try to provide reasonable notice in-app or by email when practical.
